General Terms and Conditions (GTC)

1. Scope of Application

These General Terms and Conditions (GTC) apply to all contracts between Sina Freitag – freelance artist – and her customers concluded via this website or by email. They apply both to consumers within the meaning of Section 13 of the German Civil Code (BGB) and – unless otherwise agreed – to entrepreneurs within the meaning of Section 14 BGB.

2. Conclusion of contract

The works presented on this website do not constitute a legally binding offer but serve to initiate contact and request an individual offer. A binding contract is only concluded when an order is confirmed by email or executed by delivery.

3. Payment

Payment is to be made exclusively in advance (e.g., bank transfer or PayPal), unless otherwise individually agreed. All prices are agreed individually and communicated as part of the order confirmation. Where legally required, prices include the applicable value-added tax (VAT).

4. Delivery

Delivery is made to the delivery address specified by the customer. Shipping costs, delivery times, and any shipping restrictions will be communicated individually as part of the offer.

5. Right of withdrawal

Information on the right of withdrawal can be found in the cancellation policy.

6. Warranty

The statutory warranty rights apply. For custom-made or personalized works, the right of withdrawal may be excluded (§ 312g para. 2 no. 1 BGB).

7. Liability

We are fully liable for damages caused by intentional or negligent behavior that result in injury to life, body, or health. For other damages, we are only liable in cases of intent or gross negligence. Liability under the Product Liability Act remains unaffected.

8. Data protection

9. Final provisions

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). For consumers with habitual residence in another EU country, the mandatory provisions of that country also apply. If the customer is an entrepreneur, the place of jurisdiction is the seat of Sina Freitag.
